We invite you to read our Terms and Conditions of Sale carefully. By browsing this website, you agree to be bound by all of these conditions, even if you choose not to read them.

These terms define the rights and obligations of the parties for all sales made on Davincia.ca. They govern the placement and processing of orders. Any order or purchase made on this site is subject to the clearly stated terms and conditions.

These conditions apply exclusively to the end consumer, meaning any individual aged 18 or over who is not acting as a merchant.

Davincia may modify its Terms and Conditions of Sale at any time. We encourage you to review this page regularly to be aware of the applicable conditions, which are binding upon you. In the event of modification, the terms in effect on the day of the order shall apply. In case of dispute, electronic records shall serve as proof between the parties.

You may save or print these Terms and Conditions of Sale. By visiting the davincia.ca website, you acknowledge and accept our Policies and Conditions.


1. LIABILITY

Davincia cannot be held responsible for any improper use of its products. Before placing an order, the customer declares that they have full legal capacity to accept these Terms and Conditions of Sale.

Davincia disclaims all responsibility regarding:

  • the temporary malfunction of the website or the inability to access it (maintenance, updates, etc.). Davincia will inform members of any upcoming maintenance or update operations to minimize navigation difficulties; 
  • improper use of the site caused by external factors (inadequate equipment, network congestion, etc.);
  • indirect damages, viruses, hacking, loss of data, or records stored on the site;
  • delivery delays attributable to carriers, which do not entitle the customer to any compensation;
  • any direct or indirect damage occurring during the delivery of packages.

Ownership of the products remains with Davincia until full payment is received. Once delivered, the products become the responsibility of the customer.

2. ACCURACY OF INFORMATION 

The information displayed on davincia.ca (images, descriptions, advice, videos, prices, etc.) is provided for informational purposes only. Davincia strives to ensure its accuracy and updates it regularly, but reserves the right to modify it at any time without prior notice.

The presence of a product or service on the site does not guarantee its availability at all times.

3. COPYRIGHT

The davincia.ca website presents Davincia’s products and services and allows their online purchase. All of its content (texts, images, videos, descriptions, etc.) is protected by trademark and copyright laws.

It is strictly prohibited to modify, reproduce, or use this content for public, commercial, or unauthorized purposes. Any unauthorized use may result in legal action.

4. PAYMENT

The customer must ensure the accuracy of all information provided when placing an order. Davincia cannot be held responsible for errors made by the customer that may result in delays or an inability to deliver the order.

Prices are in Canadian dollars. Applicable taxes vary depending on the shipping address (GST/QST in Quebec; GST/HST elsewhere in Canada).

Shipping fees are indicated before order confirmation. Davincia may adjust its prices in the event of increased costs or an obvious error.

Secure payment is made via PayPal. Davincia may cancel any order in the event of payment refusal. A confirmation email is sent once the order is accepted.

The merchandise remains the property of Davincia until full payment is received.

5. ORDERS  

Before confirming the order, the customer may review its details (products, prices, taxes, shipping fees). By confirming the order, the customer submits a purchase offer that Davincia accepts once payment is completed, followed by a confirmation email.

Davincia only accepts deliveries within Canada.

5.1 Modification or Cancellation

An order cannot be cancelled if:

  • execution fees have already been incurred;
  • the package is already in transit.​
5.2 Order Processing  

Orders are processed from Monday to Thursday, excluding holidays (January 1–2, Good Friday, Easter Monday, Victoria Day, June 24, July 1, Labour Day, Thanksgiving, December 25).

No orders are processed between December 24 and January 2.

Shipments occur on business days (Monday to Friday). The customer must monitor emails sent by Davincia, as they may contain important information about the order.

Davincia may limit quantities or refuse or cancel an order deemed abnormal (excessive quantities, repeated orders to the same address, etc.). For orders of more than 10 units of the same product, please contact: info@davincia.ca.

6. RETURN POLICY 

No refunds. Exchanges only, for a product of equal or lesser value. Return shipping costs are the responsibility of the customer.

If you are not satisfied with your purchase, contact us within 30 days of delivery at info@davincia.ca. The receipt and original packaging are required for any exchange.

6.1 Defective or Damaged Products 

In the case of a defective product (within 30 days) or a product damaged upon receipt, contact us promptly. The return must include:

  • proof of the issue (photo/printout);
  • the original box in good condition.

The customer is responsible for the package until it is received by Davincia.

No return will be accepted without a return authorization number.

 7. PRICES, PROMOTIONS, AND CONTESTS  
7.1 Prices  

Prices are indicated in Canadian dollars, excluding taxes and shipping fees. They may vary throughout the year, but orders are billed according to the prices in effect at the time of purchase.

7.2 Promotional Offers  

Promotions are valid only in Canada and on davincia.ca for the period indicated. They cannot be combined, except with free shipping.

7.3 Contests  

By participating in a contest displayed on davincia.ca, you agree to:

  • these policies;
  • the contest rules;
  • the applicable laws.
